Terms of Service

1. Use of Services

Skip Trace Depot provides automated skip tracing services via a software-as-a-service (SaaS) platform. By using our services, you agree to comply with all applicable laws. You must be at least 18 years old to use our platform.

2. User Responsibilities

You are responsible for uploading clean, properly formatted data and mapping it correctly to the required fields. This applies to both homeowner and business/LLC files. Poor input or incorrect mapping may affect results.

3. FCRA Disclaimer

Skip Trace Depot is NOT a consumer reporting agency as defined by the Fair Credit Reporting Act (FCRA), 15 U.S.C. 1681 et seq. The data and services we provide do not constitute "consumer reports" as defined by the FCRA. You may NOT use any data obtained through our services for purposes covered by the FCRA, including but not limited to:

  • Credit eligibility decisions
  • Employment screening or hiring decisions
  • Tenant screening or housing decisions
  • Insurance underwriting
  • Any other purpose requiring FCRA compliance

You also agree not to use our data or services for stalking, harassment, intimidation, or any unlawful purpose. You must comply with the Drivers Privacy Protection Act (DPPA), the Telephone Consumer Protection Act (TCPA), applicable state laws, and all other applicable federal and state regulations when using data obtained through our platform.

By using our services, you certify that you will use the data solely for legitimate business purposes such as real estate investment, marketing, debt recovery, or legal proceedings, and in full compliance with all applicable laws.

4. Data Reliability

While we strive for accuracy, all data is provided on an "as-is" basis. Property records are sourced from public county assessor offices and other publicly available sources. Occasional gaps, delays, or inaccuracies may occur and are outside our control.

5. No Guarantees or Warranties

Skip tracing involves inherent limitations. Not all data may be returned, especially for LLCs or Incs. We do not guarantee availability or accuracy of contact information. Results are provided "as is."

6. Charges and Billing: Pay Per Match

Skip Trace Depot charges only for records that return a match. A record is a "hit" if the results include at least one phone number or at least one email address. A record that returns no phone number and no email address is a "miss" and is not charged. For parcel and land traces, a record is a hit when we resolve the current owner's name or a phone number. Per-job minimums apply: $1.00 for standard jobs, $3.00 for advanced jobs, and $3.00 for parcel jobs, regardless of how many hits are returned. Credits are deducted per hit, not per record submitted: standard hits deduct 1 credit, advanced hits deduct 3 credits, and parcel hits deduct 5 credits. By submitting your mapping or payment, you accept the pricing structure shown at checkout.

7. Business Skip Tracing Specific Terms

  • Business and LLC skip tracing is not offered. Rows identified as business entities are detected and excluded automatically: not traced and not billed.
  • Business rows are returned in your delivered file with all original columns intact, marked "Not traced (business entity)", so your list stays complete.

8. DNC Scrub Service Specific Terms

  • The DNC Scrub service checks phone numbers against the United States National Do Not Call (DNC) registry at the moment of the scrub request. DNC status is highly time-sensitive: the registry adds and removes numbers continuously, and a phone may change status at any time after the scrub completes.
  • Each scrubbed phone number is returned with a status of "ok" (not on the federal DNC registry at scrub timestamp), "dnc" (listed on the federal DNC registry at scrub timestamp), "unknown" (lookup failed or timed out), or "n/a" (cell was empty so nothing to scrub). The scrub timestamp is recorded with each result.
  • The DNC Scrub service does not check state-level Do Not Call lists, internal company DNC lists, wireless 411 lists, reassigned-number databases, or any other suppression list outside the federal DNC registry. You are solely responsible for any additional suppression lists your campaign requires.
  • You agree to re-scrub phone numbers within 31 days of any outbound campaign. Skip Trace Depot may send a reminder email or in-app notification when a prior scrub becomes stale, but the responsibility to re-scrub before each campaign rests with you.
  • Skip Trace Depot makes no representation that a phone number marked "ok" will remain off the DNC registry at the time you contact it. Your reliance on a stale scrub result is at your own risk.
  • You remain solely responsible for compliance with the Telephone Consumer Protection Act (TCPA), the Federal Trade Commission's Telemarketing Sales Rule, A2P 10DLC carrier registration requirements for SMS campaigns, state-level Do Not Call laws, prior express consent rules, and any other applicable consumer protection law.
  • The DNC Scrub service is provided on an as-is basis with no warranty of completeness, currency, or fitness for any specific compliance purpose. Skip Trace Depot disclaims all liability arising from your use of DNC Scrub results in any outbound campaign.

9. Refunds

Refunds are only considered under specific conditions, such as unprocessed records or service initiation failure. See ourRefund Policyfor details.

10. Data Usage and Confidentiality

We treat your files with confidentiality. Submitted files are temporarily stored and deleted after processing. We do not resell or share your file contents. See ourPrivacy Policy.

11. Account Termination

We reserve the right to suspend or terminate service for misuse, illegal activity, or system abuse.

12. Limitation of Liability

We are not liable for indirect or consequential damages. Our maximum liability will not exceed the amount you paid for the service that gave rise to the claim.

13. Indemnification

You agree to indemnify and hold Skip Trace Depot harmless from any claims or damages related to your use of our services or violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of California. All disputes shall be handled in the courts located in Los Angeles County, California.

15. Changes to Terms

We may update these Terms at any time. Updates will be posted on this page. Continued use of our Services implies acceptance of the new Terms.

Prepaid Credits (Addendum)

What they are.Prepaid credits are advance payments for skip-tracing services and are tied to a single email address. Credits do not expire and may be transferred to another email upon request.

Rates & top-ups.Prepaid balances are debited at the rates published on our pricing page or order invoice. Tiered discounts may be offered and are subject to change without notice.

Recognition on mapping.When you enter your email on the mapping step, the system recognizes your balance, shows remaining credits, and estimates the credits required for the current job.

How charges apply.Credits applyfirst. If your balance fully covers the job, it starts immediately with no payment step. If there’s a shortfall, only the uncovered portion is billed at the prevailing rate at checkout.

Holds & deductions.At submission we place a hold for the validated record count; upon completion we deduct the actual processed records and release any unused hold.

Scope.Service targetsindividual property owners. Matches forLLCs/corporationsare not guaranteed and may return only main office details.

Anti-abuse.To prevent volume-discount arbitrage, we may decline refunds after credits are used and/or require re-pricing of used records at current rates when considering any discretionary accommodation.

17. Lead Lists & Lead Builder Specific Terms

The Lead Lists product (also marketed as "Lead Builder," "Custom Lead Builder," and the preset-specific landing pages including but not limited to motivated-seller leads, refi-ready leads, cash-buyer lists, inherited property leads, absentee owner lists, pre-foreclosure leads, high-equity leads, and vacant property leads) delivers a CSV of property records selected by Skip Trace Depot from public-record and consumer-data sources based on the customer's chosen preset, geography, and filter criteria.

  • Selection is non-personalized. Identical inputs (preset, geography, filters) will return substantially the same record pool across orders, including for repeat orders by the same customer. Records returned in a new order may overlap with records the customer received in prior orders. Overlap is an inherent property of the underlying data architecture and is not a defect, error, or failure of the service.
  • No deduplication against prior orders. Skip Trace Depot does not, and is not obligated to, exclude records that appeared in the customer's prior Lead Lists orders. The customer is responsible for client-side deduplication if avoiding overlap is important to their workflow.
  • Overlap is not grounds for refund or chargeback. Charges are based on the total number of rows delivered, not the number of unique-to-the-customer rows. By submitting a Lead Lists order, the customer accepts that overlap with prior orders may occur and that the published per-row price applies to all rows delivered regardless of overlap status.
  • Property-attribute filters are best-effort. Filter criteria (equity, lender, year built, distress signals, etc.) reflect data available at the time of the query. Skip Trace Depot does not warrant that every returned record matches every filter in real time, only that the selection was made using the requested filter criteria against the underlying data layer as of the query timestamp.

18. Property Lookup Specific Terms

The Property Lookup product delivers a single-address report containing public-record property attributes, owner identification, contact information (where available and DNC-scrubbed), and propensity scores.

  • Automatic refund for non-hit results. If Skip Trace Depot's data layer returns no property record for the submitted address ("no hit"), the lookup fee is automatically refunded to the original payment method. The customer is not required to request the refund — it is initiated by Skip Trace Depot at the time of the lookup.
  • Automatic refund when property is found but no owner contact data is available. If a property record is located but the data layer returns no usable owner phone numbers or email addresses, Skip Trace Depot will automatically refund the lookup fee on the basis that the bundled product was not delivered.
  • No refund for accurate-but-undesired results. Refunds are not available for properties whose returned attributes (owner identity, equity, lender, condition, etc.) do not match the customer's expectations, prior research, or subjective beliefs about the property, so long as the data was returned in good faith from the underlying data layer.
  • Multi-unit and commercial properties. County records often list multi-unit residential and commercial properties at the parcel (building) level only. The Property Lookup returns building-level ownership and contacts in those cases, not per-unit. This is disclosed in the product wizard before purchase.

19. Overlap, Match Rates, and Industry Baselines

Skip Trace Depot publishes industry-baseline match rates (approximately 25% right-party contact rate on cold property lists is a common benchmark across the property-data industry) for transparency. Achieved match rates on any individual order may be higher or lower than this baseline. The customer acknowledges that match rate is not the same as record-locate rate, and that variance from any published baseline is not a defect.

20. Acceptance of These Terms

By creating a Skip Trace Depot account, submitting a job for processing, completing a purchase, or clicking through any paid checkout, the customer acknowledges that they have read, understood, and agreed to be bound by these Terms of Service, the Privacy Policy, and the Refund Policy as they exist on the date of acceptance. Continued use of Skip Trace Depot services following any update to these Terms constitutes acceptance of the updated Terms.

21. License Scope, No Resale, No AI Training

The customer is granted a non-exclusive, non-transferable, revocable license to use data delivered by Skip Trace Depot for their internal business purposes only. The customer may not:

  • Resell, redistribute, sublicense, or otherwise transfer Skip Trace Depot-delivered data to any third party, except as required in the ordinary course of the customer's documented business (e.g., delivering a lead to a co-broker on a single deal). Bulk resale, reselling lists, or reselling per-record access is expressly prohibited.
  • Use Skip Trace Depot-delivered data to train, fine-tune, evaluate, or otherwise develop any machine-learning model, large-language model, or other algorithmic system, whether for internal use or for sale.
  • Aggregate Skip Trace Depot-delivered data into a competing data product or data marketplace.
  • Scrape, crawl, mass-download, or otherwise programmatically extract data from Skip Trace Depot interfaces except via the documented authenticated API endpoints made available to the customer.

22. California Consumer Privacy Notice (CCPA / CPRA)

For California-resident consumers whose personal information may appear in Skip Trace Depot's data layer: you may have rights under the California Consumer Privacy Act (CCPA), the California Privacy Rights Act (CPRA), and the Delete Act (SB 362) to request access, correction, or deletion of your personal information. To exercise these rights, please email [email protected] with the subject "CCPA Request." Skip Trace Depot is not a Consumer Reporting Agency under FCRA and not a credit-reporting service. Eligible requests will be honored in compliance with applicable California law.

23. Class Action Waiver and Individual Arbitration

To the maximum extent permitted by applicable law, any dispute arising out of or relating to these Terms or the Skip Trace Depot services shall be resolved by individual binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, in Los Angeles County, California. The customer and Skip Trace Depot each waive any right to participate in a class action, class arbitration, or representative action. Claims may be brought only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

24. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified only to the minimum extent necessary to make it enforceable.
